Terms of Service

1. Agreement to these terms

By using Fitbase, you agree to these Terms of Service (“Terms”). Please read them carefully.

If you are using Fitbase on behalf of a training studio or gym, you confirm that you have authority to bind that business to these Terms.

If you do not agree to these Terms, do not use Fitbase.

2. Who we are

Fitbase is WhatsApp automation software for personal trainers, operated by Joiin Flow (Pty) Ltd, a company registered in South Africa (“Joiin Flow”, “we”, “us”, “our”).

3. The service

3.1 What Fitbase does

Fitbase Agent replies to client enquiries and can schedule training sessions on a trainer’s own WhatsApp number, using that trainer’s own session and package data. Fitbase is a software tool for personal trainers and training studios — it is not a directory or marketplace, and it does not advertise or refer clients to trainers.

3.2 Fitbase Agent

Fitbase Agent operates on the WhatsApp Business API provided by Meta Platforms, Inc. Your use of it is also subject to WhatsApp’s Business Policy, available at business.whatsapp.com. Fitbase is an independent product and is not affiliated with, endorsed by, or sponsored by Meta or WhatsApp.

3.3 Service availability

We aim to keep Fitbase available at all times but do not guarantee uninterrupted access. We may perform scheduled maintenance and will notify customers in advance where possible.

4. Your account

You are responsible for the accuracy of the session types, packages, pricing, and availability information you configure in Fitbase, since Fitbase Agent replies to your clients using exactly that data.

5. Acceptable use of Fitbase Agent

You may not use Fitbase Agent to:

• Send unsolicited messages (spam) to contacts who have not opted in
• Send messages that violate WhatsApp’s Business Policy
• Distribute false, misleading, or fraudulent information about a session, package, or price
• Violate any applicable law, including the Consumer Protection Act or POPIA

6. Pricing and payment

Fitbase is available on Trainer (WhatsApp automation for one trainer) and Team (WhatsApp automation for a studio) plans. Current pricing is available on our pricing page. Demos are available for both plans before you commit. Prices are subject to change with 30 days’ notice to existing customers.

7. Cancellation and termination

7.1 Cancellation by you

Customers on a paid plan may cancel at any time by contacting us at support@joiinflow.com. Cancellations take effect at the end of the current billing cycle.

7.2 Termination by us

We may suspend or remove an account or Fitbase Agent access immediately if:

• These Terms are breached
• WhatsApp’s Business Policy is violated
• The account is used for illegal or harmful activity
• We are required to do so by law

8. Data

We process personal information in accordance with our Privacy Policy. Where Fitbase Agent processes your clients’ personal information on your behalf, you act as the responsible party under POPIA.

9. Intellectual property

All intellectual property rights in Fitbase, including the software, design, and Fitbase Agent, belong to Joiin Flow (Pty) Ltd. Your own business content (session details, packages, branding) remains your property.

10. Disclaimers and limitations

10.1 Service provided as-is

Fitbase is provided on an “as is” and “as available” basis. We make no warranties, express or implied, regarding uninterrupted availability of the service.

10.2 Limitation of liability

To the maximum extent permitted by law, Joiin Flow’s total liability to you for any claim arising from your use of Fitbase is limited to the amount you paid us (if any) in the 3 months preceding the claim.

We are not liable for any indirect, incidental, or consequential damages arising from your use of Fitbase, including any transaction or session booked between you and your own clients.

11. Changes to these terms

We may update these Terms from time to time. When we make material changes, we will notify affected customers by email at least 14 days before the changes take effect.

12. Governing law and disputes

These Terms are governed by the laws of the Republic of South Africa.

We will first attempt to resolve any dispute informally. Please contact us at legal@joiinflow.com. Nothing in this clause prevents either party from seeking urgent interim relief from a court of competent jurisdiction.

13. General

13.1 Entire agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Joiin Flow regarding your use of Fitbase.

13.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full force.
